<p><br />Aggravated Unlicensed Operation of a motor vehicle or AUO (NYS VTL 511-1a) is the crime of driving a motor vehicle even after you were order by a Court that you may not drive, also known as <strong>Driving with a suspended license</strong><strong>.</strong> No matter which Court ordered you not to drive, if that Court has jurisdiction is New York State, you can be arrested, charged and convicted of a misdemeanor if you are caught operating a motor vehicle. If you are not sure if your license is suspended or if you were charged with driving on a <a href="https://trafficticketviolationattorney.com/traffic-violations/suspended-license-violations/">suspended license, call an attorney immediately</a>.<br /><br />A common application of this law is when a motorist fails to respond to, or fails to pay a traffic ticket. The Court which has jurisdiction over that traffic ticket is empowered to order the NYS DMV to suspend the motorist&#8217;s driver&#8217;s license for failing to pay or failing to respond to their traffic ticket. Notably, as long as you do not drive a motor vehicle you can not be arrested. However if you do drive a car and are stopped you can be arrested for violating a Court order.</p>

<p>What happens if you fail to respond to a traffic in a state other than New York? Usually what happens is that the NYS DMV will respect the suspension order originating in this other state and suspend your driver&#8217;s license here in New York. If you don&#8217;t have a NYS driver&#8217;s license and you are suspended in another state, it stands to reason that NYS will not issue a suspension against you, and you will be merely unlicensed in NY, not suspended in NY, being that this Court outside of NY does not have the power to suspend your driver&#8217;s license in NY.</p>
<p>If you are arrested or charged with Aggravated Unlicensed Operation, or Driving on a suspended license call a New York State attorney to protect you from serious criminal convictions.</p>

<p>When a cop pulls you over and asks you &#8220;Do you know why I pulled you over?&#8221; many think that it&#8217;s only polite to respond. You can&#8217;t just leave a guy hanging right? The common legal advise to use your right to remain silent seems so wrong. &#8220;Don&#8217;t talk to cops&#8221; doesn&#8217;t seem correct in real life. I am here to tell you that this is simply not the case.</p>
<p>You see, when a cop asks you &#8220;Do you know why I pulled you over?&#8221; he or she is lying to you. They don&#8217;t care if you know why you are receiving a traffic ticket, nor are they there to lecture you. Police officers are trained to interrogate perpetrators by engaging them in conversation. They hope to obtain a confession which will make convicting you easier, and they also hope to ensnare you into a traffic offense or a crime that they themselves did not see you commit.</p>

<p>What police officers would really say if they were being honest is &#8220;please confess to me that you just committed the crime that I witnessed and a new one that I did not&#8221;. Not responding will actually raise the level of respect the officer has to you.</p>
<p>So the next time a New York State Trooper asks you &#8220;Do you know why I pulled you over?&#8221; remember that the cop is not there to help you, and be proud of your 5th amendment right to remain silent, and don&#8217;t talk to cops. </p>

										<content:encoded><![CDATA[<p>As seen in the video a cop doesn&#8217;t mind that the motorist is complying, and you can see the multiple burn marks from the pepper spray. The police officer says that he pepper sprayed the motorist&#8217;s girl friend once because she got out of the car and would not get back in, however she reports that he pulled her out of the car by her hair, handcuffed her, and pepper prayed her while she was already on the ground handcuffed. In the audio which is not on video you can hear the cop tell a paramedic &#8220;let her enjoy it&#8221; referring to the pepper spray and about the paramedic helping her out. Police Brutality? I think you could call it that.</p>
<p>Part of the confrontation was caught on the lady&#8217;s ipad. The police officer did not show up to the Court when subpoenaed. A civil suit against the officer&#8217;s police brutality and violation of civil rights has been filed.</p>

<p>Unreal.</p>
<p>Some people as me why I represent criminals. How can you work to reduce a traffic violation which endangers someone&#8217;s life?</p>
<p>One answer is you can&#8217;t always take a police offer&#8217;s word for what happened.</p>
<p>Most officers of the law are upstanding individuals with sterling character, and are trust worthy in every way. Others not so much. Some cops look at the force as the biggest gang in town. They ride the power rush and don&#8217;t take kindly to anyone who opposes them.</p>
<p>That is why we have a Court Room, and a Judge, and we don&#8217;t convict people based on the testimony of any cop who wares a badge. Part of traffic ticket lawyer&#8217;s job, is to make sure that justice doesn&#8217;t get lopsided.</p>
