New York Failing to Move From Lane Attorney

Due to the recent tragedies of police officers being struck while they are on the side of the highway, the New York legislators have enacted a law which requires one to move one full lane away from the lane in which an emergency vehicle is stopped with it’s lights flashing. (Not to be confused with the requirement to yield to a emergency vehicle 1144-a)

While this new law carries 2 points it is considered to be a “chutzpah” that one has “failed to exercise due care for an emergency vehicle stopped or standing” (see the wording of the law NYS VTL § 1144a-a). Being that many police officers have lost their lives on the side of the road, the Courts are very strict about this charge.

One is not required to move out of their lane if doing so would endanger another vehicle or if such an action is in violation of another law.

Failing to move Over Violation

A violation for failing to move out of your lane can add 2 points to your driving record. While this might not seem like a significant amount, if you accumulate 11 points within an 18-month period, you will likely have your driver’s license suspended.
